There is a bill before the VA Legislature this session that would exempt VA residents born before July 1, 1972 from the requirement to have taken & passed the Boater Safety course. This is just nonsense to exempt older individuals due to age. As you will see below, the stats show that 2/3's of the fatalities in 2014 were caused by individuals over the age of 45.
The Chamber of Commerce has gotten involved with this as the legislation also proposed to change the requirements regarding the rules for rental boat companies - originally drafted as requiring anyone renting to have to have passed the full course - seems like a reasonable thing to me but the Chamber's concern is regarding the economic impact to the marias and surrounding businesses.... I'm not going to comment on that side of it however, if legislation is drafted to "protect" the waterways against individuals renting boats without the full coursework, then why loosen the rules on the other side for older VA residents - my guess is some legislators or their backers don't want to have to take the time to sit down and take the course to ensure they know the rules.... just nonsense.
This is going on real-time - it has already been to committee and it appears that perhaps the changes related to the rental requirements have been modified - but the age-out item still stands. This can directly affect the safety of our waters at SML, so if you have an opinion on this, then you need to make it heard ASAP.

I was recently made aware that the Virginia General Assembly is considering a change to EXISTING boating safety legislation that threatens to undermine the positive trends we have seen in terms of boating accidents since the Boating Safety Education training requirements first came into effect in 2009. The boating safety education compliance requirement will be fully phased-in on July 1, 2016. As of July 1, 2014, all operators of personal watercraft (e.g., jet skis) and motorboat operators 45 years old and younger must complete a boating safety course. Beginning July 1, 2015, motorboat operators ages 50 and younger and all personal watercraft operators must complete the boating safety course.
SB 996 (Stuart) would exempt motorboat operators born prior to July 1, 1972 (age 43 and older), and who are residents of Virginia, from having to demonstrate compliance with boating safety education requirements before operating a motorboat.
There is no justification for exempting older operators from the boating safety education requirements. According to DGIF statistics, in 2014, 10 of the 15 fatalities (2/3) were caused by operators over 45 years old.
No one is immune from mishaps and operators of all ages and experience levels can benefit from FREE boating safety education.
While I fall into the category that would be made exempt, as a property owner on Smith Mountain Lake, and someone who spends over 100 days a year on the water, it is unacceptable to me that the Legislature would be considering a change to standing regulation that exempts boaters of a specific age - especially when the statistics show that older boater contributed to a larger share of fatalities than their younger counterparts. There is no age-out requirement to have proper training & license to operate a motor vehicle on the State's motorways, and safety is of upmost importance on our motorways - and we must ensure that the same is in place for our waterways.
I strongly urge you to reject the proposed bill and leave the Boater Safety Education requirements in place as stands today regarding age limits.
